Article 1. Applicability of General Terms and Conditions of Use

1. These General Terms and Conditions of Use (hereafter: ‘Terms and Conditions’) have been prepared by Tuesday Studio, having its registered office in Amsterdam and registered with the Chamber of Commerce under number 74866338.

2. These Terms and Conditions apply to the use of the Human Nature – The Film platform developed by Tuesday Studio and operated in cooperation with its Partners. User of the platform can download these Terms and Conditions from the website humannaturedefilm.nl so that they can be saved or printed.

3. By using the platform, User agrees with these Terms and Conditions, the Privacy statement and Cookie statement on humannaturedefilm.nl l as well as with any additional conditions/adjustments to ensure the proper functioning of the platform.

Article 2. Definitions

1. Platform: the online platform called Human Nature – The Film. Human Nature – The Movie offers users of the online video platform the possibility to view content on various devices, such as a smart TV, a smartphone, a tablet, desktop and laptop.

2. User: the natural person who uses the platform.

3. User agreement: the agreement which is entered into by registration, agreeing to these Terms and Conditions.

4. External provider: any legal entity, including a social network (Facebook, Instagram, etc.), not being Tuesday Studio or its Partners, that processes data at the User’s request, for example to share this data with third parties.

7. Peripheral equipment: the equipment, including a smartphone or tablet with which you make use of the platform, including the corresponding operating system.

8. Content: all data (including images and sounds), services, software, files, ideas or other information accessible via the platform.

9. Conditions: these general terms and conditions of use of Human Nature – The Film Platform.

Article 3. Right of Use Platform

1. Tuesday Studio grants to the User from the moment of registration during the term of the User Agreement a non-exclusive, non-sublicensable and non-transferable right to use the platform for personal non-commercial use. Any other use requires the prior written consent of Tuesday Studio. The platform can be used on up to one (1) device at a time per account.

2. The User is not allowed to make the platform available to a third party (including making log-in data available), to sell, rent out, subject to reverse engineering or to modify it without the prior written consent of Tuesday Studio Nor may the User remove or circumvent technical provisions intended to protect the platform.

3. Tuesday Studio has the right at all times to adapt the offered functionality of the platform in order to improve or change the functionality and to fix errors, as well as to make available and/or implement updates and upgrades at its own discretion. In addition, Tuesday Studio has the right to delete data, deny further use of the platform and terminate the license, set restrictions on the use of the platform, and/or block access to the platform in whole or in part, temporarily or permanently.

4 Tuesday Studio will do its utmost to keep the platform functional for the benefit of the User but does not guarantee that the platform will always remain available and will always work flawlessly in the future.

Article 4. Application and registration

1. In order to be able to use the platform, User must register. The information requested, such as name and email address, is necessary to be able to use the platform.

2. If User is younger than 16 years of age, he/she needs the permission of a parent or legal representative to use the platform. By using the platform, you guarantee that you are 16 years of age or older or have the permission of a parent or legal representative.

Article 5. Rates

1. Tuesday Studio does not charge any fees for the use of the platform. Provided that videos are offered for a fee.

2. The User shall bear the costs for the purchase and use of the Peripheral Equipment and connections (mobile and/or wireless internet) required for the use of the platform.

Article 6. Equipment and Connections

1. The platform will only function with the aid of the necessary Peripheral Equipment and (internet) connections. In order to be able to make use of the platform, the User must ensure that he or she has the necessary Peripheral Equipment and connections.

2. In order to prevent abuse and/or malfunctions and other problems, User must ensure that the Rand Equipment and connections are sufficiently secure, for example against unauthorized use by third parties and viruses.

3. The User guarantees Tuesday Studio that the used Peripheral Equipment and connections do not cause any damage to Tuesday Studio and/or Partners or third parties or that no rights of Tuesday Studio, the Partners and/or third parties are violated.

4. Tuesday Studio is not liable for any damages or costs resulting from its peripheral equipment or connections including – but not limited to – damages resulting from non-delivery, delay, manipulation or interception of the delivery of electronic messages and/or the functionalities of the platform or otherwise the improper functioning of the platform and resulting damage.

Article 7. Privacy and Cookies

1. When processing personal data, Tuesday Studio adheres to the applicable regulations, including the General Data Protection Regulation and the Telecommunications Act. The way Tuesday Studio handles the personal data of Users is described in the privacy statement and cookie statement on humannaturedefilm.nl.

2. If the User provides his/her personal data to an External Provider and also installs an app that uses these personal data, the User, by installing the app, gives permission to the External Provider to make these data available to Tuesday Studio for the purposes listed below, all this in compliance with the other privacy provisions listed on the website(s) of the External Provider and Tuesday Studio.

Article 8. Intellectual Property

1. The platform and the Content, the data, images, sounds, texts and combinations thereof and other software are protected by copyright, database rights and other intellectual property rights. These rights belong exclusively to Tuesday Studio or its licensors. Without prior written permission of Tuesday Studio it is not allowed to copy any part/content of the platform or to disclose, exploit or use it in any other way in (un)edited form.

Article 9. Liability

1. Tuesday Studio does not guarantee that the platform will function at all times and without interference. Tuesday Studio reserves the right to put the platform partly or completely (temporarily) out of use in connection with the performance of maintenance or modification work.

2. Despite the constant care and attention paid to the composition of the platform, Tuesday Studio cannot guarantee the completeness, accuracy or continuous updating of the Content. Tuesday Studio accepts no liability for any direct or indirect damages of any kind arising from or in any way related to the use of the platform/ Content, (in)accessibility of or errors in the platform or the Content made available, software, downloads or other data files, and products and services purchased through the platform or otherwise.

3. Tuesday Studio is not liable for the availability of (mobile) internet and/or the operation of the used Peripheral Equipment by User.

4. The above exclusions of liability of Tuesday Studio also apply to all auxiliary persons and third parties engaged by Tuesday Studio.

Article 10. Termination of use

1. The user may terminate the use of the platform humannaturedefilm.nl at any time by no longer using the user account, or Human Nature – The Film to request the deletion of the user account.

2. Tuesday Studio is entitled to block access to an account or permanently exclude a User from further use of the platform, without giving reasons.

3. Tuesday Studio is authorized at all times to change the Content of the platform and/or the fees related to the platform (including but not limited to charging fees for downloading from the platform).

Article 11. Use of equipment and software of third parties

The use of equipment and software from third parties, which could be necessary for using and/or visiting Human Nature – The Film, is subject to the conditions of use of these third parties. The user is responsible for observing the conditions of use of third parties. The terms and conditions of use of, among others, Apple and Google may apply when using the platform.

Article 12. Applicable law and competent court

1. These Terms and Conditions, the use of the platform and any disputes arising therefrom or related thereto are governed exclusively by Dutch law.

2. Any disputes arising from these Terms and Conditions or the use of the platform should be submitted to the competent court in Amsterdam. Tuesday Studio is entitled to amend these Terms and Conditions from time to time.
